Disclaimer & Limitation of Liability

1.1 General Disclaimer
All tours, services, and information provided by South Florida SUV Tours are offered on an “as is” and “as available” basis. While we take every reasonable precaution to ensure the safety and satisfaction of our guests, participation in outdoor and wildlife tours involves inherent risks that cannot be entirely eliminated.
By booking a tour with us, you acknowledge and accept these inherent risks and agree that the Company is not liable for any injury, illness, loss, or damage — whether direct, indirect, incidental, or consequential — arising from your participation in any tour.
1.2 Assumption of Risk
Outdoor tours in South Florida, including Everglades excursions, coastal tours, and off-road or backcountry experiences, may involve exposure to:
• Wild animals including alligators, crocodiles, venomous snakes, biting insects, and marine life.
• Extreme heat, humidity, severe thunderstorms, lightning, and tropical weather conditions.
• Uneven terrain, unpaved roads, water crossings, and other physical hazards.
• Sun exposure and risk of heat exhaustion, dehydration, or sunburn.
• Allergens including plant pollen, insect stings, and environmental irritants.
Guests assume full and voluntary responsibility for all such risks by participating in our tours. We strongly recommend that all guests obtain travel insurance prior to their visit.
1.3 Limitation of Liability
To the fullest extent permitted by applicable Florida law, South Florida SUV Tours, its owners, officers, employees, guides, agents, and independent contractors shall not be liable for:
• Any personal injury, death, or property damage arising out of participation in any tour, except where caused by the Company’s gross negligence or willful misconduct.
• Any loss, theft, or damage to personal property, including cameras, electronic devices, jewelry, or luggage.
• Any consequential, indirect, incidental, punitive, or special damages of any kind whatsoever.
• Any losses arising from third-party service providers engaged in connection with our tours.
• Any dissatisfaction with wildlife sightings, tour route changes, or weather conditions, as these are inherently unpredictable.

In all cases where Company liability is established, the maximum liability of the Company shall not exceed the total amount paid by the Guest for the specific tour booking giving rise to the claim.
1.4 Waiver of Liability
Prior to certain tours — particularly those involving off-road terrain, water activities, or Everglades wilderness experiences — guests may be required to sign a separate written Waiver of Liability. Such waivers supplement and do not replace the terms of this Disclaimer. Refusal to sign a required waiver may result in the guest being unable to participate in the relevant tour, with cancellation terms applying.
1.5 Health & Medical Disclaimer
Our tours involve varying levels of physical activity. Guests with heart conditions, respiratory conditions, mobility impairments, pregnancy, severe allergies, or any other medical condition that may be affected by outdoor activity, heat, or physical exertion should consult a physician before booking. The Company is not responsible for any health-related incident arising from a pre-existing condition.
Our guides are not medical professionals. In the event of a medical emergency during a tour, we will contact emergency services (911) immediately and provide reasonable first aid assistance until professional help arrives.
1.6 Travel Insurance Recommendation
The Company strongly recommends that all guests purchase comprehensive travel insurance prior to their visit to South Florida. Travel insurance should ideally cover:
• Trip cancellation and interruption
• Medical expenses and emergency evacuation
• Personal liability
• Loss of personal property and luggage
The Company is not affiliated with any travel insurance provider and does not receive compensation for insurance recommendations.
1.7 Photographic & Video Consent
By participating in a tour, guests consent to being photographed or filmed by the tour guide or by the Company for potential use in promotional materials, social media content, and marketing. Guests who do not wish to be photographed should inform their guide at the start of the tour. We will make every reasonable effort to exclude non-consenting guests from any promotional content.
1.8 Website Content Disclaimer
The information contained on www.southfloridasuvtours.com, including blog posts, travel guides, pricing, and tour descriptions, is provided for general informational and marketing purposes only. While we strive to keep all content accurate and current, we make no warranties of any kind — express or implied — regarding the completeness, reliability, or suitability of any information on the Site. Content may be updated, changed, or removed at any time without notice.
1.9 Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and guides from and against any claims, liabilities, damages, losses, costs, or expenses

(including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of our services or website; (b) your violation of these terms; (c) your violation of any rights of a third party; or (d) any injury or damage caused by your conduct during a tour.
